TERMS OF SUPPLY - EASYBOOK TRAINING

Booking Terms and Conditions

By using this website and the Easybook Training Limited (Easybook Training) website booking service you are agreeing to be bound by the Terms and Conditions detailed below which form the basis of your contract with Easybook Training.

Easybook Training Limited is registered in England and Wales. Company Registration No: 06807554, and is VAT registered (no 683597185). Registered office address:  Easybook Training, Prospect House, 11-13 Lonsdale Gardens, Tunbridge Wells, Kent TN1 1NU.

In these Terms & Conditions “you” and “your” refers to all persons named on the booking, which includes any individual(s) subsequently added or substituted at a later date. “We”, “us” and “our” all refer to Easybook Training. Please print and retain a copy of these Terms & Conditions for your records as it may occasionally be updated.

Please note that we are only the booking agent for courses and these Terms and Conditions only apply to the use of our booking service and/or website. All courses are provided by third party suppliers and you will contract with them direct on their own terms and conditions for the delivery of those courses and training.

1. Making a booking

By making a booking you are confirming that you are authorised to do so on behalf of all persons named in the booking, you have the right to share their personal information and you are acknowledging that all members of your party agree to be bound by these Terms & Conditions. When your booking has been made a confirmation will be sent to you by email using the email address that you have supplied. You should retain a copy of this confirmation for your reference.

You should carefully check the details of your confirmation as soon as you receive it. You must contact us immediately if any of the details are incorrect or incomplete. We will always endeavour to rectify any inaccuracies or accommodate any alterations you wish to make to your booking. However, if you do not inform us of such inaccuracies, you will be deemed to have accepted the confirmation in full.

Please note that we cannot accept responsibility for inaccurate information that you have supplied.

If you contact us by email we will endeavour to respond within one working day of receiving your booking enquiry. Administration fees may apply (see 5).

For NVQs, once you are enrolled for an NVQ course, any booking fee is non-refundable.

2. Paying for your booking

Bookings made through our website must be guaranteed with a credit or debit card or paid by invoice. By credit / debit card the full payment will be deducted from your card at the time of booking to secure your reservation. As a measure of fraud prevention, you will be required to enter the three digit Card Verification Value (CVV) printed on the back of your credit or debit card when making a booking online. By Invoice, full payment must be made within the stated terms as outlined on the invoice. All prices are quoted in £GBP and include tax (VAT) at the current Government rate, unless otherwise specified.

Offline bookings can be made with us by email or telephone and paid for with a credit/debit card.  

If a booking is made by more than one person or on behalf of an employer each person is jointly and severally liable for the payment of all fees due.

3. VAT Invoice

A VAT invoice will be provided with the booking confirmation e-mail.

4. Price changes

We reserve the right to increase or decrease the price of unsold courses at any time. The price of your chosen course will be confirmed when your booking is made and, with the exception of any errors, we will not increase this price once it has been confirmed. We reserve the right to correct any errors in advertised and confirmed prices and will do so as soon as we become aware of an error. We will notify you of any price discrepancies relating to your booking should they arise, but we strongly advise you to check that the final price of your booking is correct before making your final confirmation.

5. Amendments to your booking

You should notify us of any amendments to your confirmed booking including name changes, by telephone or in writing (by post or by email) as soon as possible. Amendments are subject to availability and are subject to an administration fee of £10.00 plus any fees which the training provider may implement. Alternative course charges may apply. Name changes cannot be made to an NVQ course once the order has been placed.

6. Cancellations & Refunds Policy

Should you wish to cancel your booking the value of your refund will be in-line with the course provider's terms & conditions, which will vary. The value of the refund will vary dependant on the length of notice given and the provider's specific terms of supply.  Please contact us should you require a copy of the prevailing terms for your booking.

A cancellation confirmation will be sent back to you at the email address provided at the time of booking.

7. Cancellations and changes made by Easybook Training

 

In the unlikely event that a course is unable to accommodate a confirmed booking, it may be necessary to offer an alternative date and/or venue of an equal standard. If at any time we need to make changes that will significantly affect your course or we need to cancel your course, we will tell you as soon as possible, offering a suitable alternative or a refund. This does not apply to minor changes or events during your course resulting from unusual or unforeseeable circumstances beyond our control.

We cannot be held responsible for cancelling your booking as a result of your failure to comply with any requirement of our Terms & Conditions, and we cannot be held liable for any expenses, costs or losses incurred by you as a result of any change or cancellation.

8. Course Transfers

Bookings may be transferred only if a written transfer request is received by us 28 working days before the course commences. Transfers are subject to availability and may incur an additional fee, these will be dealt with on a case by case basis and a separate administration fee charged accordingly.

Please note that no refund can be given on any bookings which have already been transferred.  Only one transfer request can be made per course booking.  We reserve the right to cancel bookings where multiple transfer requests have been made. 

Transfers are not applicable for NVQ courses. Bookings for e-learning courses are not transferrable after a login has been sent to you.

9. In House Training Courses

In House courses are carried out at the client’s premises to one or more employees by trainers provided by our third party suppliers. Course booking requests will not be deemed to have been completed until such time as a signed booking form, or email confirming agreement to the booking terms & conditions, is received by us.

Candidate numbers must be confirmed a minimum of 72 hours prior to course commencement in order for course materials to be provided including exam papers (where applicable) for each candidate. Alterations to candidate numbers following booking confirmation may incur additional charges.

10. Virtual Courses

Virtual courses are carried out online by our third party suppliers and you will be provided with login details to access the course.

You are responsible for ensuring that your IT system is appropriate to connect to and access a Virtual course.

11. Certificates

Applicable Certificates / Awards will be sent as an e-cert format or otherwise as a document to the address you have supplied. Certificates are sent by our third party suppliers or their issuing body.

12. Third party suppliers

All courses will be supplied by third parties and such third party suppliers will have their own terms and conditions relating to the services they provide. It remains your responsibility to check and adhere to those terms and conditions for the delivery of the course.

13. Medical conditions

If you or any member of your party has a medical problem or disability which may affect your course, please contact us. We can then make provision for the particular needs of the person(s) concerned, or advise you if we are unable to make such provision. If details are not provided to us at the time of booking, we reserve the right to transfer or cancel the booking should a specific third party supplier be unable to make appropriate provision for a specific need or needs.

14. Circumstances beyond our control

We cannot accept responsibility for unforeseen circumstances beyond our control. These include (but are not limited to act of God, adverse weather conditions, fire, riot, war, terrorist activity (or threat of such activity), industrial dispute, natural disaster/or injuries and death of an individual(s) through accidental circumstances unconnected with us.

By making a booking you are accepting responsibility for any damage or loss caused by yourself or member of your party. Full payment for any such damage or loss must be paid to the third party supplier. If you fail to do so, you will be responsible for meeting any claims subsequently made (together with our own and the other party’s full legal costs) as a result of your actions.

15. Complaints

Should you be dissatisfied with any aspect of the service provided by any of our third party suppliers, you can bring it to our attention by writing to: Customer Services, Easybook Training, 11-13 Lonsdale Gardens, Tunbridge Wells, Kent TN1 1NU. Alternatively you can email training@easybooktraining.co.uk Complaints brought to our attention will normally receive a response within five working days.

16. Accuracy of information on this website

We endeavour to ensure the information contained within this website is as accurate as possible but there will inevitably be instances where information may be incorrect or out of date. It is always advisable to check specific details that may be relevant to your booking prior to making that booking. We reserve the right to amend or remove information at any time and do not accept responsibility for keeping copies of any amended or deleted information.

17. Usernames and Passwords

Our website may provide you with the ability to use usernames, passwords or other codes or devices to gain access to restricted areas. The content contained in such areas is confidential to us and is provided to you for your own specified personal or corporate use. We reserve the right to withdraw the use of such access codes at any time should we feel that their use is being abused or is likely to be detrimental to our business.

18. Our liability to you

We can only accept liability for bookings placed through us in accordance with the Terms and Conditions current at the time of booking. We cannot accept any other form of liability.  We act as a booking agent for third party suppliers and therefore all liabilities relating to the supply of the service are between you and the third party supplier. It is your responsibility to understand and accept those third party terms and conditions prior to supply of the service.

19. Website Privacy Electronic mailing list

We operate an opt-in email policy. In order to receive details about special offers and promotions from us by email you must opt-in to our mailing list.  If at a later date you wish to opt out of our mailing list you can use the link or email address provided at the bottom of any of our emails to do so. Alternatively, you can unsubscribe by updating your member log-in details. We do not send unsolicited email communications and we do not sell exchange or trade email addresses to or with third parties. Personal information relating to each delegate will only be supplied to the third party delivering the course to allow them to deliver the training course.

20. Bookings

In order to guarantee your booking you will need to provide us with specific personal details relating to that reservation. Your details will be used only for the purpose of handling that booking. When making a booking you will be transferred to a secure (SSL) server in order to provide credit or debit card information. When you are transferred to this secure server you will see a padlock icon in the bottom corner of your browser window and the URL of the page you are viewing will begin with “https”. Any information you provide while you are within this secure environment is encrypted and cannot be read by a third party. When you make a booking we will use your email address for the purpose of fulfilling that booking. This will include sending you an email to confirm your booking and may include additional communication should we need to contact you regarding specific requirements or a cancellation.

If you choose to opt-in to our mailing list during the booking process, then we will store the contact details that you have provided so that we may fulfil your request for future communication.

21. Third party websites and viruses

We cannot be held responsible for the accuracy, content or availability of information about our services or organisation that may be found on third party websites. Neither are we responsible for the content or privacy policies of any third party websites that have access to or from our website. Attempts to interfere with the operation of our website, by whatever means, or any attempt to place an unreasonable or disproportionate load on our website or server infrastructure is prohibited. In the event of our website failing to operate, either in whole or in part due to infections by computer viruses, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond reasonable control, we reserve the right in our sole and absolute discretion to prohibit usage of our site and to cancel, terminate, modify or suspend the site.

22. Copyright

All copyright and other intellectual property rights in all text, images, sounds and other materials on this website is the property of or licensed to Easybook Training and its affiliated companies. No reproduction of any part of this site may be sold or distributed for commercial gain modified or incorporated into any other work, publication or site. All names, logos, trademarks, service marks, trade dress and trade names are proprietary of Easybook Training and may not be used by anyone for any purpose without our prior express written consent. Framing or utilised framing techniques of the above or other proprietary information is also prohibited without written consent. We consider our trademarks to be valuable assets, and take infringement of these seriously. It is illegal to use any spy wares, robot, spider or other automatic devise, or manual process to track or copy the site or the contents or information without our prior express written consent, apart from the recognised major search engines such as Google & Yahoo MSN.

The use of any such material from our website on any other web, internet, intranet, extranet or other site or computer environment is strictly prohibited. Information on our site is intended for your reference only. If you have any specific queries, you should contact us directly. We nor any party involved in creating, producing or delivering this site shall be liable for any damages arising out of any access to, use of, or inability to use this website.

23. Termination

We shall be entitled to cancel your booking at any time by writing to you or notifying you by email if you:

(a)        do not make any payment to us when it is due; or

(b)        do not comply fully with these Terms & Conditions; or

(c)        provide us with false information relating to your booking; or

(d)        use rude or abusive language or behave or threaten to behave in an aggressive or violent way towards our staff or any other person.

If we cancel your booking for any of the reasons set out above, we will not refund any booking fee you have paid in advance and we may deduct or charge you for the net costs we incur as a result of your default.

24. Limitation of our liability

In the event of any breach of this contract by us, our liability shall be limited to damages for that breach. Under no circumstances shall the liability exceed the price of the services provided. All warranties and conditions whether implied by statute or otherwise are excluded from this contract provided that nothing in this contract shall restrict liability for death or personal injury caused by negligence of the company or affect your statutory rights.

Nothing in this agreement shall limit or exclude a party’s liability:

(a) for death or personal injury caused by its negligence, or that of its employees, agents or sub- contractors;

(b) for fraud or fraudulent misrepresentation;

(c) for any indemnity provided under this agreement; or

(d) for any other act, omission, or liability which may not be limited or excluded by law.

Neither party shall have any liability to the other party, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or for any indirect or consequential loss arising under or in connection with the agreement.

25. General

If any part of these Terms & Conditions is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from the remainder of these Terms & Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.

No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms & Conditions will operate as a waiver of them nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them, to be effective any waiver must be in writing

These Terms & Conditions contain the entire agreement and understanding of the parties and supersede all prior agreements understandings representations and arrangements, written or oral.

English law shall apply to this agreement, and the parties agree to submit to the non-exclusive jurisdiction of the English courts.
